The 50-year-old male Plaintiff tripped and fell due to a cracked sidewalk in a poorly lit area near his home while jogging in a South Florida County. With over $10,000 in past medical expenses, a claim for past loss wages, and loss of future earning capacity. He issued a demand for $200,000.00.

Hightower, Stratton, Novigrod & Kantor filed a Motion for Summary Judgment on behalf of the county before allowing any depositions of our clients. Defense argued that the plaintiff had failed to present any evidence that the public entity was negligent or caused the accident.

Motion for Summary Judgment was granted in favor of our business partner! The Defendant propane truck was alleged to be speeding and failed to avoid the accident. Past medical bills were incurred in excess of $130,000 trying to save the life of “Captain Steve”. He was survived by a wife and four adult children. The Plaintiff demanded $800,000 to settle the claim.

The Defense discovered multiple independent witnesses favorable to the defense and immediately set for deposition. We used the truck’s on-board technology to help prove its driver took all appropriate actions.
