Plaintiff was rear ended on his motorcycle while at a red light. The offending driver was a highly intoxicated woman that had allegedly become drunk at our client’s restaurant. The Plaintiff filed a Dram Shop claim against our client. He alleged that the accident necessitated surgeries to his back, knee and wrist, causing nearly $250,000 in medical bills.
Hightower, Stratton, Novigrod & Kantor represented the restaurant and filed a Motion for Summary Judgment based on Florida’s Dram Shop Act. We were able to prove that our client did not know the drunk driver as a habitual drunk and therefore Florida’s dram shop act did not apply to our client.
RESULT: Summary judgment granted! Case dismissed.
