On a clear day in Highlands County, our client made a U-turn in his employer’s tractor trailer across a 3 lane divided highway. Plaintiff, coming from the opposite direction alleged that he could not see the truck make the turn and collided with the right rear side of the tractor. Plaintiff claimed injuries to his low back, left shoulder, and left hand. X-rays studies revealed a compression fracture in his spine. Plaintiff later underwent a spinal augmentation surgery as a result of her injuries. However, while investigating this matter, we learned that Plaintiff left 240 to 260 feet of skid marks. With this information, we were able to determine that Plaintiff was traveling 75 to 90 mph, a whopping 15 to 30 mph over the speed limit!
RESULT: Plaintiff demanded more than $500,000. However, armed with the information above, we were able to settle for $105,000.
